Asking homeless applicant to agree extension of deadline for completing section 202 review

When a homeless applicant has requested a review of a homeless decision under section 202 of the Housing Act 1996, the local authority must notify the applicant of its decision within a prescribed time limit (see regulation 9 of the Homelessness (Review Procedure etc) Regulations 2018.

This deadline can only be extended if the applicant and council agree in writing to an extension (Reg.9(1)).

This letter enables you to request an extension by writing to the applicant. A short form is also enclosed to enable the applicant to confirm their agreement.

It is important to confirm any agreement in writing, so as to prevent an applicant appealing to the county court against the original decision (s.204(2)).
