Refusing to exercise power to withdraw section 202 review decision

A letter to confirm that you are refusing to exercise the discretion to withdraw a review decision that has already been made (under section 202 of the Housing Act 1996), and will not be re-opening the review process.

The letter uses the example of an applicant:

  • Who failed to respond to a 'minded to' letter.
  • Only contacted the Council after the review decision had been notified, but
  • Wishes to raise issues that were not considered, and
  • Cites a medical condition that may potentially have a bearing on her failure to respond within the period provided for making further representations.

The letter:

  • Briefly summarises the nature of the power.
  • Explains the implications of your refusal to withdraw the review decision.
  • Prompts you to provide reasons for concluding that, in all the circumstances, it is not appropriate to re-open the review (as well as providing a worked example of how reasons might be given).
