Section 184 decision - accepting s.189B relief duty and s.188 interim accommodation duty

A letter for notifying a homeless applicant that they:

  • are eligible,
  • are homeless,
  • are owed the section 189B(2) 'relief' duty, and
  • are owed the section 188 interim accommodation duty (because there is reason to believe they may have a priority need).

This letter is designed to be accompanied by the following documents, which are available separately:

  • A section 189A assessment.
  • A personal housing plan.
  • Temporary accommodation rules, and
  • An offer of temporary accommodation (if applicable).

The letter includes three different options in relation to how you are performing the interim accommodation duty, depending on whether:

  • the interim accommodation was previously provided (before accepting the relief duty),
  • an offer of interim accommodation is made on the same day as when this letter is notified, or
  • the applicant remains 'homeless at home', because you have decided that their pre-existing accommodation is suitable for the applicant for a short period of time (notwithstanding that it is not reasonable to continue to occupy indefinitely).
