Section 184 decision - accepting main s.193 housing duty - applicant remaining homeless at home

A letter for notifying a homeless applicant that the relief duty has ended, and they:

  • have a priority need
  • are not intentionally homeless, and
  • are owed the main duty.

Use this particular letter where:

  • You will be meeting the main housing duty by the applicant remaining 'homeless at home', i.e. they will be continuing to occupy the accommodation 'from which they were homeless'; while the accommodation is not reasonable to continue to occupy indefinitely, you have decided that it remains suitable for the applicant, for the time being.

The letter explains:

  • That the applicant can request alternative accommodation, and raise concerns if they consider the accommodation is unsuitable, or if their circumstances change.
  • That they cannot simply be left 'homeless at home' indefinitely.
  • That the council will review the suitability of the arrangement in due course.
  • That they have a right to request a review of the suitability of the accommodation.
  • The circumstances in which the main duty will end.
