Judicial review letter before claim - failure to provide interim s.188 accommodation and carry out s.189A assessment
A letter before claim that adheres to the format set out in Annex A of the Pre-Action Protocol for Judicial Review.
The letter provides an example where, following a homeless application, a council has:
- failed to secure interim temporary accommodation under section 188 of the Housing Act 1996, and
- failed to carry out and notify an assessment of the applicant's circumstances, under section 189A of the 1996 Act.
Clearly, legal advisors will need to amend the letter according to the circumstances of the specific case.
