Reg.7(2) letter - Minded to overturn decision that intentionally homeless, but minded to decide that main housing duty not owed because not homeless

A letter to notify a homeless applicant who has requested a s.202 review:

  • That you accept there was a deficiency or irregularity in the decision that is the subject of the review, or in the manner in which it was made.
  • That you are nonetheless minded to make an adverse decision on review.

Use this particular Reg.7(2) letter where:

  • A review was requested of a decision that the applicant became homeless intentionally.
  • You are minded to accept that the applicant did not become homeless intentionally, but
  • You are minded to decide that the main housing duty is not owed because the applicant is not homeless.

The letter informs the applicant:

  • Of your reasons for considering that there was a deficiency or irregularity in the original decision.
  • Of your reasons for being minded to decide that the main housing duty is not owed.
  • That they can make oral and/or written representations.
  • How such representations can be made.
  • The deadline for making representations.

The letter includes optional text, if you need to ask the applicant for an extension to the statutory deadline for completing the review.
